1. Definitions

“Company”, “we”, “us”, “our” refers to HOME 4U, located at 5B Rue Oscar 2, 06000 Nice, France.

“Client”, “you”, “your” refers to any natural or legal person making a booking via our website or other communication channels.

“Accommodation” or “Property” refers to the furnished property offered for rent on our platform.
-
“Booking” or “Reservation” refers to the confirmation of the rental of an Accommodation for a specified period.
-
“Rental Agreement” refers to the furnished rental contract (“bail meublé”) governed by French law, which must be signed by both parties.
2. Object of Services
HOME 4U offers furnished properties for mid-term rental in Nice, France, primarily intended for an international clientele whose primary residence is not in France. Our services include:

Fully furnished apartments available for rental periods of one (1) month minimum.

Flat-rate utility charges including heating, electricity, water, and high-speed internet.
-
Concierge and welcome services.
-
Continuous support via email and WhatsApp throughout the rental period.
All rentals are governed by a Rental Agreement under French law (Articles 1708 et seq. of the Civil Code), expressly excluding the provisions of the Law of July 6, 1989, as the property does not constitute the Client’s primary residence.
3. Booking
3.1 Booking Process
To make a reservation, the Client must:

Select an Accommodation and the desired dates on our website.

Complete the booking form with accurate personal information.
-
Pay the total rental amount at the time of booking (see Article 4).

Receive a confirmation email containing a unique booking reference.
3.2 Mandatory Documents
Within 48 hours following the booking confirmation, the Client must provide:

A signed copy of the Rental Agreement (sent by email).
Identity verification (passport or valid ID for each occupant) will be conducted in person during the key handover. No digital copy of any ID is collected or retained by HOME 4U.
Failure to return the signed Rental Agreement within the 48-hour timeframe will result in the automatic cancellation of the booking and a full refund.
3.3 Confirmation
The booking is considered final and binding only after:

Receipt of the full payment.

Submission and verification of all mandatory documents.
-
Signature of the Rental Agreement by HOME 4U and its return to the Client.
4. Payment Terms
4.1 Full Payment Required
Important: The total rental amount must be paid in full at the time of booking. No deposit, installment plans, or partial payment arrangements are available.
4.2 Minimum Rental Duration
The minimum rental duration is one (1) calendar month.
4.3 Payment Methods

| Bank Transfer | Must include the booking reference. The invoice and Rental Agreement will be sent upon receipt and verification of the payment. |
4.4 Liability for Damages
Important Information: No security deposit is required for the rental. However, the Client is informed that they remain fully liable for any damage caused to the Accommodation, its furniture, or its equipment beyond normal wear and tear noted during the check-out inventory.
In the event of damage, HOME 4U will estimate the repairs based on professional quotes or invoices. The Client agrees to pay the corresponding amount within thirty (30) days of receiving detailed notification of the damages and associated proof. Failure to pay within this timeframe gives HOME 4U the right to initiate any amicable or legal recovery proceedings, with all associated costs borne by the Client.
4.5 Currency
All prices are quoted and payable in Euros (EUR). Currency conversion fees, if any, are the responsibility of the Client.
5. Cancellation Policy

Cancellation requests must be submitted in writing via email. The date of receipt determines the applicable cancellation tier.
The signed Rental Agreement must be returned within 48 hours of the booking confirmation. Failure to return this document will result in automatic cancellation with a full refund.
6. Check-in and Check-out
6.1 Check-in
Upon arrival, the Client will be welcomed in person for the key handover, and a joint check-in inventory of fixtures (“état des lieux d’entrée”) will be conducted. A photographic record may be attached.
6.2 Check-out
Upon departure, a joint check-out inventory will be conducted. The Client must return the Accommodation in the same condition as received, allowing for normal wear and tear. Any damage will be documented and billed in accordance with Article 4.4.
6.3 Overstay
If the Client fails to vacate the Accommodation on the agreed date, an occupancy indemnity equal to 120% of the daily rental rate will apply for each day of overstay, without constituting a tacit renewal of the agreement.
7. Client Obligations
The Client agrees to:

Use the Accommodation exclusively for temporary or secondary residential purposes.

Maintain the Accommodation and its furnishings in good condition.
-
Not sublet, assign, or transfer the right of occupancy.
-
Make no alterations or modifications without prior written consent.
-
Comply with building rules and local regulations, particularly noise restrictions.
8. Insurance
HOME 4U maintains comprehensive property insurance covering all Accommodations under its management. This includes multi-risk coverage for rental risks, water damage, fire, and civil liability related to the Accommodation.
The Client is not required to take out a separate home insurance policy for the duration of their stay; HOME 4U assumes this obligation on behalf of all tenants.
However, the Client remains personally liable for any damage caused intentionally or through gross negligence, as well as damage to their personal belongings, which are not covered by HOME 4U’s insurance. The Client is encouraged to purchase personal travel or luggage insurance if desired.
9. Early Termination
The Rental Agreement is for a fixed term. Early termination by the Client is permitted under the following conditions:

A minimum of one (1) month’s written notice sent via email or registered mail.

Rent remains due during the notice period, unless the Accommodation is re-rented before the end of this period, in which case the Client will only owe rent up to the new tenant’s occupancy date.
No additional penalty or compensation will be due beyond the rent for the notice period.
10. Termination by the Company
The Company may terminate the Rental Agreement by right, one (1) month after a formal notice remains unheeded, in the event of:

Non-payment of rent or utility charges.

Use of the Accommodation contrary to its intended purpose.
-
Any serious breach of the Rental Agreement obligations.
11. Intellectual Property
All content on our website, including text, photographs, graphics, logos, and trademarks, is the exclusive property of HOME 4U and is protected by applicable intellectual property laws. Reproduction, distribution, or use of any content without prior written consent is strictly prohibited.
12. Limitation of Liability
HOME 4U shall not be held liable for:

Indirect, incidental, or consequential damages.

Loss of personal property during the stay.

Temporary interruptions of services (electricity, water, internet) due to force majeure or third-party provider issues.

Any event beyond its reasonable control.
HOME 4U’s total liability for any claim arising from a booking shall not exceed the total amount paid by the Client for that booking, except in cases of gross negligence or willful misconduct by HOME 4U, for which liability is not limited.
13. Privacy Policy and Data Protection (GDPR)
13.1 Data Collected
We collect and process the following personal data exclusively for the management of your rental:

Full name, date of birth, nationality.

Contact details (email, phone number, address).

Passport or ID number (recorded during the in-person identity check upon arrival).

Payment information (processed securely via Stripe; we do not store full credit card details).
13.2 Purpose and Legal Basis
Your personal data is processed for the performance of the rental contract (Article 6(1)(b) GDPR) and for compliance with legal obligations (Article 6(1)(c) GDPR).
13.3 Identity Verification and Data Retention
Key data protection commitments:

No scans or copies of passports or IDs are collected or stored. Identity is verified visually in person during the key handover.

Signed contracts are stored exclusively internally on secure servers.

Personal data is retained only for the duration required by French law.

Access to personal data is strictly limited to two (2) authorized personnel within HOME 4U.

We do not share, sell, or transfer personal data to third parties, unless required by law.
13.4 Your Rights
Under the General Data Protection Regulation (GDPR), you have the right to access, rectify, or erase your personal data (subject to legal retention obligations), restrict its processing, request data portability, and object to certain processing activities.

13.5 Data Security
We implement appropriate technical and organizational measures to protect your personal data against unauthorized access, loss, destruction, or alteration.
14. Communication
Our primary communication channels are email (for booking confirmations, invoices, contracts, and official communications) and WhatsApp (for real-time support, arrival coordination, and concierge assistance).
All formal contractual communications (cancellations, complaints, formal notices) must be made in writing via email.
15. Force Majeure
Neither party shall be held liable for any failure or delay in the performance of their obligations when such failure or delay results from circumstances beyond their reasonable control, including but not limited to: natural disasters, pandemics, government actions, war, strikes, or major public utility failures.
16. Governing Law and Jurisdiction
These General Terms and Conditions and any Rental Agreement established via our platform are governed by French law.
Any dispute arising from or in connection with these Terms and Conditions will be brought before the competent court as determined by applicable law, which may be the court of the defendant’s domicile, the court of the place where the Accommodation is located, or, for consumers residing in the European Union, the court of the consumer’s place of residence, in accordance with Regulation (EU) No 1215/2012 and the French Code of Civil Procedure.
17. Severability
If any provision of these General Terms and Conditions is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
18. Amendments
HOME 4U reserves the right to modify these General Terms and Conditions at any time. The version applicable to a booking is the one in effect at the time the booking is made. Updated Terms will be published on our website with the revision date.
